The use of catering accommodation services in the household Villa Ulmus, Margaroti 94c, Karojba, Croatia, ("Villa Ulmus" or "we") and your interaction with us is subject to these Terms of Use ("Terms"). The terms and conditions are an integral part of the contractual relationship that arises from the moment of contracting the catering service of accommodation in Villa Ulmus from our offer ("Accommodation").
Villa Ulmus pays special attention to preserving your privacy and protecting your personal data. You can read more about which, how and why we process your personal data in our Privacy and Cookies Notice, which are also on our website.
The terms used in these Terms and have a gender meaning apply equally to the masculine and feminine gender.
The applicable law for these Terms is considered to be the laws and other regulations of the Republic of Croatia, as well as the law of the European Union applicable in the Republic of Croatia.
By using this website, you acknowledge and agree that (a) this is a fair balance because the website is available to you, free of charge; and (b) IF THERE IS ANY PART OF THESE TERMS THAT YOU DO NOT AGREE TO, INCLUDING A LIABILITY EXEMPTION, PLEASE DO NOT USE OUR SERVICES.
Any possible changes to these Terms will be published exclusively on this website, and the previous modification will be decided exclusively by the competent Villa Ulmus.
When you visit our website, contact us through it, send us an e-mail or contact us by phone, you communicate with us electronically, or express your will to enter into an electronic form of communication with Villa Ulmus. Therefore, we will also communicate directly with you by e-mail, by telephone or indirectly by placing a notification on this website.
However, the process of contracting accommodation is carried out exclusively by e-mail.
Finally, we use the electronic form of communication to deliver you all notifications, announcements, and especially to help you when you arrive and stay in the selected villa and to answer all your questions, i.e. to provide you with the requested service.
Villa Ulmus presents you with an overview of the villa's terms and procedure, contracting the Accommodation, the payment policy and the cancellation policy of the Accommodation. For the purpose of greater transparency, the booking and payment process is described in the form of answers to the most frequently asked questions:
Accommodation from our offer published on our website. For this accommodation, a detailed description of the content, location and prices is available, and appropriate photos of the villa are attached.
Villa Ulmus reserves the right to change the price list and information without prior notice on the website. However, the change in the price list of accommodations and services will in no way affect the already incurred reservations and / or contracted Accommodations.
Changes in the exchange rate of foreign currencies may also affect the change in the price of services, for which Villa Ulmus is not responsible.
In case of price errors or any other omissions, Villa Ulmus reserves the right to adjust prices or make any other corrections.
The price of accommodation includes the costs of water, gas, electricity, internet, maintenance of the pool and outdoor area and the use of bed linen, towels and kitchen towels and the like. VAT is not calculated on the basis of Art. 90th st. 2 of the VAT Act.
We make the reservation of the villa exclusively by e-mail, we will send you an offer for stay by e- mail, which you can accept only by e-mail. By e-mail, you also provide the information we need to contract the Accommodation. Otherwise, the Accommodation will not be considered contracted.
It is possible to get information by phone, but not to make a reservation of the Accommodation.
Please note that when booking, you are required to provide the number of guests, which must not exceed a maximum of 6 people.
Please note that you are responsible for providing us with accurate and true information. If you do not provide accurate and true information, you are responsible for all costs, i.e. consequences arising from incorrect data.
After you have selected the period of time in which you plan to stay, Villa Ulmus will send you an offer for payment with the amount of a non-refundable advance to the e-mail address. Advance payment is included in the price of accommodation.
You are obliged to pay the advance amount within 3 (three) business days.
The accommodation is considered contracted after you have paid the amount of the advance. After the payment is visible in our bank account, we will send you a confirmation that will contain information about the reservation, the amount you have paid, the amount you still need to pay and what dynamics.
With regard to the payment of the remaining amount of the Accommodation price, the following options are possible:
The final invoice for the Accommodation service will be issued to you directly upon arrival at the Villa and delivered to you upon completion of the Accommodation service. The invoice will be on the full price of the Accommodation (including the full amount of the advance previously paid).
If you do not pay the advance amount within 3 (three) business days, Villa Ulmus will cancel your reservation.
If you do not pay the rest of the accommodation price within the deadlines you will be notified of during the arrangement of the Accommodation and through the Confirmation, Villa Ulmus reserves the right to cancel the Accommodation service while retaining the entire amount of the advance. In any case, in situations where you are obliged to pay the rest of the accommodation price before arriving
at the villa, Villa Ulmus will make sure that it reminds you of the payment obligation in time so that there is no cancellation of the Accommodation.
You can cancel the Accommodation service only in writing, by sending an e-mail to Villa Ulmus.
The advance payment as well as the paid rest of the accommodation price are not refundable in case of cancellation of the Accommodation, regardless of the reason for cancellation.
If you pay by bank transfer, you are responsible for all the costs of the bank transaction. The account of Villa Ulmus must include a full payment for your Accommodation.
In accordance with the conditions stated here, Villa Ulmus will treat you with the care of a good host, will make sure that your Accommodation service is adequately performed and within its capabilities will take care of your rights and interests while taking into account good customs in tourism.
Our employees will act towards you as a contact point for all your inquiries and needs related to accommodation.
Villa Ulmus or its partners are not responsible for the acts or omissions of any governmental body, their officers or employees or any employee or agent of airlines, airlines, ticket operators, other land carriers, shipping companies or operators, cruise or ferry operators, all other carriers, hoteliers or other accommodation providers, all other tour service providers, travel guides, travel agents and/or providers of food and beverages, other goods and services with whom you have entered into a relationship during your stay in the villa, and over whom Villa Ulmus or its partners have no direct control.
Villa Ulmus is not liable for any injury, loss, death, inconvenience, delay, damage to personal property or other damage related to the provision of any goods or services, whether as a result of, but not limited to, the impact of force majeure, disease, pandemic and epidemic, war crimes, civil unrest, insurgency, animal damage, strikes or other work activities, any criminal or terrorist activities, overbooking or substandard provision of service, food poisoning, mechanical or other failure of aircraft or other means of transport or failure of any transport mechanism ensuring timely arrival or
departure and any events beyond the control and/or influence of Villa Ulmus. For example, Villa Ulmus will not be responsible for the inability to use the Accommodation due to the decisions of third parties and accordingly neither for the refund of any of the guests received amounts nor will they be obliged to ensure a change of the already agreed date of the Accommodation.
Villa Ulmus nor its partners are not responsible for any terms or requirements of any third party that provides you with a particular service during your vacation, which is not an Accommodation service. If you decide that you do not wish to visit any country or part of the country you intended to visit because of any laws, conditions or requirements of any government or government authority, official or agent, you are solely responsible for any costs and compensations, loss or damage incurred as a result of that possible cancellation or altered fees.
Villa Ulmus is not liable for any injury, loss, reclamation, damage or any special, exemplary, punitive, indirect or consequential damages of any kind (including but not limited to lost profits) related to the performance or non-performance of the services of any travel service provider, whether based on contract, tort, strict liability or otherwise.
Villa Ulmus and its partners are not liable for any damage and / or delay in the provision of accommodation services caused by force majeure. A force majeure event includes, but is not limited to, the work of God, government action, war, political riots and riots, civil conflicts, industrial disagreements, labor disputes, strike, natural or nuclear disaster, fire, theft, epidemics and pandemics of disease, other diseases, malfunctions or malfunctions in equipment, weather conditions, quarantine, medical or customs regulations, technical or administrative transport problems, airport closures, changes in the timetable of ships, vehicle failures, lack of water and other changes beyond our control.
Villa Ulmus is not obliged to provide a refund of the paid funds (advance and/or the rest, the full amount of the Accommodation) if you cannot use the Accommodation due to force majeure that does not prevent the provision of the Accommodation service.
Villa Ulmus requires payment of a security deposit for the purpose of insuring against any damage, accidental damage or similar events caused by your negligence, loss of property, additional cleaning, or outstanding accounts that may have arisen during your stay. In doing so, if such damage occurs and exceeds the amount of the deposit paid, you will be liable to compensate for the full cost of the damage incurred.
If there is no need to keep the security deposit, it will be returned to you after the end of your stay in the villa. The assessment of whether it is necessary to return or keep the security deposit and in what amount will be made by Villa Ulmus, if possible and before you leave the villa. However, if this is not practical due to early / late departures, an inspection of the villa will be made after your departure, and the refund of the deposit amount subsequently to your account. Villa Ulmus reserves the right to contact you later if, when inspecting the villa, it is established that while retaining the entire amount of the security deposit, you must compensate the difference up to the actual amount of the damage.
If you discover any problems or damage upon arrival, you are obliged to report them immediately to Villa Ulmus to avoid any misunderstandings after the end of the stay period.
A valid passport or identity card (for EU citizens) is required to enter Croatia. We advise that before confirming the reservation or contracting the Accommodation, check your passport and/or ID card and determine whether it will remain valid throughout the entire period of the trip. It is desirable that you do the same for the passengers who come with you. Villa Ulmus is not responsible if you will not be able to use the Accommodation service due to inadequate travel and/or personal documents.
Also, we advise you to check with the competent embassy before booking whether you need a visa to enter the Republic of Croatia. Villa Ulmus is not responsible if you will not be able to use the Accommodation service due to non-compliance with any visa requirements for entry into the Republic of Croatia.
You are obliged to comply with customs and foreign exchange regulations. If you cannot continue your journey due to non-compliance with the regulations, you will bear all the costs and consequences that arise as a result.
Villa Ulmus is not obliged to provide travel insurance for the needs of your stay in the villa.
However, obtaining travel insurance is not a prerequisite for contracting accommodation. Also, Villa Ulmus is not qualified, authorized or obliged to answer technical questions about the advantages, exclusions and conditions of any offered insurance, nor to assess the adequacy of the existing insurer of the covered insured.
If you have a specific medical condition that is causing you to travel problems or difficulties, and you are thinking about traveling, we advise you to consult your doctor before traveling. This especially if the state of health requires daily routine care, urgent care or a risky pregnancy.
Villa Ulmus is not able to provide medical services or emergency care in case of need for the same. As travellers, you are responsible for all risks, incidents or consequences caused during your stay in the villa, which are related to your health or otherwise difficult physical condition.
Villa Ulmus is also not obliged to provide you or the passengers accompanying with health insurance during their stay in the villa. Villa Ulmus is not qualified, authorized or obliged to answer technical questions about the advantages, exclusions and conditions of any offered insurance, nor to assess the adequacy of the existing insurer of the covered insured.
In accordance with Art. 10th century. 3 of the Consumer Protection Act ("Official Gazette", No. 41/14), we inform consumers that they can file a complaint expressing their dissatisfaction with the provided service in writing in these business premises, and without delay the receipt of this complaint will be confirmed in writing.

On the submitted complaint of the service user without delay in writing, the receipt of the complaint will be confirmed.
We will respond to the written complaint of the consumer in writing no later than 15 days from the date of receipt of the complaint.
Competent authority whose official supervision is subject to the activity of catering services Villa Ulmus: Tourist Inspection, State Inspectorate, Šubićeva 29, 10 000 Zagreb
For all disputes related to the application of these conditions, the Municipal Court in Pazin, permanent service in Labin with the application of Croatian law, has jurisdiction.
These Terms and Conditions shall enter into force on the day of publication on the Villa Ulmus website.
Any amendment to these Terms shall be made and made public and communicated in accordance with the provisions of these Terms.
